These Terms of Service explain the rules that apply when you visit the Lumetriq website, create an account, communicate with us or purchase products through our online store.

Section 01

About Lumetriq

This online store is operated by LUMETRIQ, a company registered in the Republic of South Africa under registration number 2026 / 414761 / 07.

Throughout this website, the terms “Lumetriq”, “we”, “us” and “our” refer to LUMETRIQ. The terms “customer”, “consumer”, “you” and “your” refer to the person visiting the website, creating an account, communicating with us or purchasing products.

Section 02

Acceptance of these terms

By accessing or using this website, creating an account, submitting an order or purchasing a product, you agree to be bound by these Terms of Service and the policies incorporated into them.

These Terms of Service must be read together with our:

  • Return and Refund Policy;
  • Shipping Policy;
  • Privacy Policy;
  • Contact Information Policy; and
  • Any product-specific instructions, warnings or warranty terms displayed before purchase.

If you do not agree to these terms, you should not use the website or place an order.

Section 03

Legal capacity and age

You must have the legal capacity to enter into a binding agreement before placing an order.

If you are under 18 years of age, you may use this website or place an order only with the involvement, permission and supervision of a parent or legal guardian.

By placing an order, you confirm that:

  • The information you provide is accurate and complete;
  • You are authorised to use the selected payment method;
  • You have legal capacity to enter into the transaction, or appropriate guardian consent; and
  • You will comply with applicable laws and these terms.
Section 04

Shopify and our online store

Lumetriq’s online store is hosted using Shopify’s e-commerce technology. Shopify provides the platform that enables us to display products, receive orders and administer online transactions.

Certain checkout, payment, hosting, security or technical functions may be provided by Shopify or other authorised service providers.

Lumetriq remains responsible for its own products, customer communications and obligations under applicable South African consumer law.

Section 05

Product information

We take reasonable steps to describe and display products accurately, including their main features, materials, dimensions, colours, compatibility requirements and intended uses.

Product photographs may appear slightly different depending on lighting conditions, camera settings, production batches or the display settings of your device.

Minor visual differences that do not materially change the nature, quality, function or advertised characteristics of a product will not necessarily constitute a defect.

Material accuracy remains protected. This clause does not permit Lumetriq to supply a materially different product, misrepresent its characteristics or avoid responsibility for goods that do not match their description.

Customers should read the complete product description, specifications, measurements and compatibility information before placing an order.

Section 06

Product availability

Products are offered subject to availability. Adding a product to your cart does not reserve it.

If a product becomes unavailable after an order has been placed, we will notify you as soon as reasonably possible and may:

  • Offer an equivalent or suitable alternative for your approval;
  • Offer to wait for stock where a reasonable restocking period is expected; or
  • Cancel the affected product and issue the refund required by applicable law.

We will not substitute a materially different product without your agreement.

Section 07

Prices and currency

Unless clearly stated otherwise, all prices displayed on the Lumetriq store are in South African rand.

Product prices, discounts, delivery costs, taxes and any other applicable charges will be displayed or calculated before you complete checkout.

Prices may change from time to time, but a later price change will not ordinarily affect an order that has already been accepted.

Promotional prices apply only during the stated promotional period and while qualifying stock is available.

Section 08

Pricing and listing errors

Despite reasonable care, a product may occasionally be displayed with an obvious pricing, description, stock or technical error.

Where an obvious error is identified before an order is accepted, Lumetriq may correct the error and invite you to place or confirm the order at the correct price.

Where payment has already been received for an order that cannot lawfully or reasonably be fulfilled because of an obvious error, we will contact you and provide an appropriate correction, alternative or refund.

Section 09

Placing an order

When you submit an order, you are making an electronic offer to purchase the selected products at the displayed price and on these terms.

After submission, you may receive an automated order acknowledgement. This confirms that our system has received the order but does not necessarily mean that the order has been accepted.

Subject to applicable consumer law, the order is accepted when Lumetriq:

  • Sends confirmation that the order has been accepted or dispatched;
  • Makes the product available for agreed collection; or
  • Otherwise expressly confirms acceptance of the order.

Different products within the same order may be accepted or dispatched separately.

Section 10

Order verification and cancellation

Lumetriq may request reasonable information to verify an order, payment method, delivery address or suspected security concern.

Subject to applicable law, we may decline or cancel an order where:

  • Payment is declined, reversed or not successfully completed;
  • Required verification information is not provided;
  • The product is unavailable;
  • The order appears fraudulent, unlawful or unauthorised;
  • An obvious material pricing or technical error occurred;
  • Delivery cannot reasonably be completed to the supplied address; or
  • The order breaches a lawful quantity, territorial or promotional restriction disclosed before purchase.

If Lumetriq cancels an order after receiving payment, any refund due will be processed in accordance with applicable law and our Return and Refund Policy.

Section 11

Payment

Available payment methods are displayed during checkout and may be provided through third-party payment gateways.

By selecting a payment method, you authorise the relevant payment provider to process the transaction and confirm that you are authorised to use the supplied payment details.

Lumetriq does not ask customers to provide an online banking password, card PIN or one-time password through ordinary email or WhatsApp.

Payment fraud warning

Do not send card PINs, passwords or one-time passwords to anyone claiming to represent Lumetriq. Contact us directly if a payment request appears suspicious.

Section 12

Delivery

Delivery options, estimated delivery periods and applicable delivery charges are described in our Shipping Policy or displayed during checkout.

Delivery periods are estimates unless Lumetriq expressly agrees to a guaranteed delivery date.

You must provide a complete and accurate delivery address, contact number and any access information reasonably required by the courier.

Lumetriq will provide notice of a material or unavoidable delay as soon as reasonably possible after becoming aware of it.

Your rights where goods are not delivered within an agreed or legally required period remain protected.

Section 13

Delivery inspection and reporting

Please inspect the parcel and product as soon as reasonably possible after delivery.

Contact Lumetriq promptly if:

  • The parcel appears materially damaged;
  • The product is missing or incomplete;
  • You received the incorrect product;
  • The delivered quantity is incorrect; or
  • The product appears damaged or defective.

Where reasonably possible, include photographs of the outer packaging, courier label, internal packaging and affected product.

Reporting periods do not erase legal rights. A request that courier damage be reported promptly helps us investigate the delivery and is not intended to unlawfully shorten a statutory warranty or consumer remedy.
Section 14

Risk and ownership

Subject to applicable law, the risk of accidental loss or damage remains with Lumetriq until the products are delivered to you, your authorised representative or the agreed delivery location.

Ownership of the products passes to you after full payment has been received and the products have been delivered.

Where you independently arrange collection through a courier or representative not selected or controlled by Lumetriq, risk may pass when the product is handed to that authorised person, subject to applicable law.

Section 15

Returns, refunds and exchanges

Returns, refunds, repairs and exchanges are handled in accordance with Lumetriq’s Return and Refund Policy and applicable South African consumer law.

Depending on the circumstances, you may have rights relating to:

  • Eligible electronic-transaction cooling-off periods;
  • Direct-marketing cooling-off periods;
  • Incorrect, incomplete or damaged deliveries;
  • Unsafe, defective or poor-quality goods;
  • Goods that do not match their description; and
  • Products that fail an applicable communicated purpose.

No statement in these terms limits a remedy that the customer is legally entitled to select for a valid statutory claim.

Section 16

Product warranties

Lumetriq products are supplied subject to the implied warranties, quality standards and remedies required by applicable South African law.

A manufacturer may also provide an additional warranty. Any additional manufacturer warranty operates alongside, and does not replace, a consumer’s statutory rights.

Warranty coverage may not apply to damage caused by:

  • Deliberate misuse, abuse or neglect;
  • Accidental damage occurring after delivery;
  • Unauthorised alteration, dismantling or repair;
  • Incorrect installation or assembly;
  • Failure to follow supplied warnings or instructions;
  • Use outside the stated specifications or limits; or
  • Normal wear and tear that is reasonable for the product and its period of use.
Section 17

Product safety and responsible use

Important safety notice

Sports, gym, outdoor and camping products may involve physical, environmental, electrical, heat, load-bearing or equipment-use risks. Read all instructions and warnings before use.

Customers must:

  • Use products only for their reasonably intended purpose;
  • Follow the supplied assembly, charging, cleaning, maintenance and safety instructions;
  • Observe weight, age, environmental and compatibility limits;
  • Inspect sports and outdoor equipment before each use;
  • Stop using a product if it appears damaged, unstable, unsafe or defective; and
  • Keep products away from children where adult supervision is required.

A product is not a substitute for professional medical, emergency, safety or technical advice.

Statutory liability remains intact. This safety section does not exclude Lumetriq’s responsibility for defective or unsafe goods, gross negligence, misleading instructions, or any liability that may not lawfully be excluded.
Section 18

Website accounts

Where customer accounts are available, you are responsible for maintaining the confidentiality of your account credentials and for taking reasonable steps to prevent unauthorised access.

You must notify Lumetriq promptly if you suspect that your account has been accessed or used without authorisation.

Lumetriq may suspend or restrict an account where reasonably necessary to investigate fraud, unlawful activity, security concerns or a material breach of these terms.

Account restrictions will not be used to withhold a lawful refund, avoid an existing order obligation or prevent a customer from exercising a statutory right.

Section 19

Acceptable website use

You may use the Lumetriq website only for lawful personal or commercial shopping-related purposes.

You may not:

  • Use the website for unlawful, fraudulent or deceptive activity;
  • Introduce malware, harmful code or automated attacks;
  • Attempt to bypass website security or access restricted systems;
  • Scrape, copy or harvest data in a way that materially burdens the website or infringes rights;
  • Impersonate another person or submit false information;
  • Interfere with another customer’s use of the website;
  • Use content in a way that infringes intellectual-property rights; or
  • Submit abusive, threatening, discriminatory or defamatory communications.

We may take reasonable technical or legal steps to protect the website, customers and business against prohibited conduct.

Section 20

Intellectual property

Unless otherwise indicated, the Lumetriq name, logos, branding, graphics, website layout, product-page designs, written content, photographs, videos and other original materials are owned by or licensed to Lumetriq.

You may view and use the website for ordinary shopping and personal reference.

You may not reproduce, republish, sell, modify, distribute or commercially exploit protected Lumetriq content without prior written permission, except where permitted by law.

Third-party trademarks and product names remain the property of their respective owners.

Section 21

Reviews and customer content

Customers may be allowed to submit reviews, photographs, questions or other content.

You remain responsible for content you submit and confirm that:

  • The content is truthful and based on a genuine experience;
  • You own it or have permission to submit it;
  • It does not unlawfully reveal another person’s personal information;
  • It does not infringe intellectual-property rights; and
  • It is not fraudulent, abusive, defamatory or unlawful.

By submitting content for publication, you grant Lumetriq a non-exclusive, royalty-free licence to host, reproduce and display that content for operating, marketing and improving the store.

Lumetriq may moderate or remove content that breaches these terms, but will not manipulate genuine reviews merely because they are critical.

Section 22

Third-party links and services

The website may contain links to courier services, payment providers, social-media platforms, manufacturer resources or other third-party websites.

Third-party platforms operate under their own terms and privacy practices. Lumetriq does not control independent third-party websites and cannot guarantee their continued availability or accuracy.

This clause does not exclude responsibility where a third party acts as Lumetriq’s agent, operator or service provider and the law places responsibility on Lumetriq.

Section 23

Personal information and privacy

Lumetriq processes personal information for legitimate purposes such as:

  • Processing and fulfilling orders;
  • Arranging payment and delivery;
  • Providing customer support;
  • Managing returns, refunds and warranties;
  • Preventing fraud and improving security;
  • Maintaining legally required transaction records; and
  • Sending marketing communications where lawfully permitted.

Personal information will be handled in accordance with our Privacy Policy and applicable data-protection law, including the Protection of Personal Information Act 4 of 2013.

Section 24

Marketing communications

Lumetriq may send marketing communications where you have consented or where another lawful basis permits us to do so.

You may unsubscribe from electronic marketing using the unsubscribe option provided or by contacting: lumetriqonline@gmail.com .

Opting out of promotional communication will not prevent us from sending necessary transactional messages about an order, payment, delivery, return, security issue or customer-service request.

Section 25

Website availability

Lumetriq takes reasonable steps to keep the website operational, secure and accurate.

The website may occasionally be unavailable because of maintenance, updates, hosting issues, network interruptions, cyber incidents or circumstances beyond reasonable control.

We do not guarantee that every feature will be continuously available or completely free from technical errors.

Lumetriq will not rely on this provision to avoid responsibility for accepted orders, payments received or obligations imposed by law.

Section 26

Disclaimer and limitation of liability

Please read this section carefully

This section deals with circumstances in which Lumetriq’s liability may be limited. It does not remove rights or liabilities that cannot legally be excluded.

To the fullest extent permitted by law, Lumetriq is not responsible for loss caused solely by:

  • A customer’s deliberate misuse or unlawful use of a product;
  • Failure to follow clear product instructions or warnings;
  • Unauthorised repairs, modifications or installations;
  • Incorrect information supplied by the customer;
  • Independent third-party systems outside Lumetriq’s reasonable control; or
  • Events beyond reasonable control where Lumetriq took reasonable steps to reduce the effect.

Lumetriq does not exclude or limit liability for:

  • Gross negligence;
  • Fraud or intentional misconduct;
  • Unsafe or defective goods where liability applies by law;
  • Death, injury or property damage where liability may not lawfully be excluded;
  • Breach of obligations imposed by the Consumer Protection Act; or
  • Any other liability that may not legally be excluded or limited.
Section 27

Customer responsibility and indemnity

To the extent permitted by law, you are responsible for direct loss reasonably caused by your intentional unlawful conduct, fraudulent activity or material breach of these terms.

You will not be required to indemnify Lumetriq for:

  • Lumetriq’s gross negligence;
  • A defective or unsafe product;
  • A breach of Lumetriq’s statutory obligations;
  • Loss caused by a person acting under Lumetriq’s control where the law places responsibility on Lumetriq; or
  • Any liability that cannot lawfully be transferred to a consumer.
Section 28

Events beyond reasonable control

Lumetriq will not be treated as being in breach merely because performance is temporarily prevented by an event beyond its reasonable control, provided that Lumetriq acts reasonably and complies with applicable law.

Such events may include:

  • Severe weather or natural disasters;
  • Widespread transport or courier interruptions;
  • Power, telecommunications or infrastructure failures;
  • Government restrictions or changes in law;
  • Civil unrest, labour disruption or public emergencies;
  • Cyber incidents not caused by a failure to take reasonable safeguards; or
  • Other events that could not reasonably have been prevented.

We will notify affected customers where reasonably possible and provide available cancellation, refund or alternative options required by law.

Section 29

Complaints and dispute resolution

We encourage customers to contact Lumetriq first so that we can investigate and attempt to resolve complaints fairly.

Please provide:

  • Your name and order number;
  • A clear description of the complaint;
  • Relevant photographs, messages or documents; and
  • The outcome you are requesting.

Complaints may be submitted through:

If a dispute cannot be resolved directly, a consumer may use any complaint, ombud, tribunal, regulatory or court process available under South African law, including approaching the National Consumer Commission or another body with jurisdiction.

Section 30

Governing law and jurisdiction

These terms, the website and transactions concluded through the Lumetriq online store are governed by the laws of the Republic of South Africa.

Any court proceedings must be brought before a South African court that has lawful jurisdiction over the parties and dispute.

Nothing in this section prevents a consumer from approaching a competent ombud, regulator, tribunal, consumer-protection authority or court where applicable law permits them to do so.

Section 31

Electronic communications

By using the website or communicating electronically with Lumetriq, you agree that notices, order confirmations, invoices, policies and other communications may be provided in electronic form where legally permitted.

Electronic communication may include:

  • Email;
  • Website notices;
  • Shopify account or checkout notifications;
  • SMS; or
  • WhatsApp messages initiated or authorised by the customer.

You are responsible for keeping your contact information accurate and for checking messages relating to your order.

Notices to Lumetriq

General notices and customer-service communications may be sent to:

A return parcel must not be sent to the physical service address unless Lumetriq has specifically confirmed that address for the return. An authorised return address or collection arrangement will be supplied during the return process.

Section 33

Changes to these terms

Lumetriq may update these terms to reflect legal, regulatory, operational or technical changes.

Updated terms will be published on this website with a revised “last updated” date.

A material change will not retrospectively remove a right that had already arisen or unfairly alter an order that was already accepted.

The version in effect when an order was accepted will ordinarily govern that order, except where a later legal requirement provides the customer with greater protection.

Section 34

Severability

If a provision of these terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted, limited or severed only to the extent necessary.

The remaining lawful provisions will continue to apply where they can operate fairly and independently.

Section 35

No waiver

A failure or delay by either party to enforce a right does not automatically waive that right.

A waiver is effective only for the particular matter for which it was clearly given and will not remove a statutory right that cannot lawfully be waived.

Section 36

Entire agreement

These terms, together with the product description, order confirmation and incorporated store policies, form the agreement governing your use of the store and purchase.

This clause does not exclude:

  • A representation that legally forms part of the transaction;
  • A product claim or promise relied upon by the customer;
  • A statutory warranty or remedy; or
  • Liability for false, misleading or deceptive conduct.
